Terms of Service for Unconditional

Welcome to Unconditional. These Terms of Service ("Terms") govern your use of the Unconditional mobile application (the "App") operated by UNCONDITIONAL.AI PTY LTD, ABN pending ("we," "us," or "our").

By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Description of Service

Unconditional is a voice-based AI companion app designed for personal development and self-reflection. The App uses a methodology called Unconditional Self-Therapy (UST), which incorporates:

• Parts work (dialogue with different aspects of yourself), inspired by Internal Family Systems
• Body awareness and somatic exercises
• Mindfulness practices

The App provides:

• Real-time voice conversations with AI
• Structured weekly training modules for personal growth
• Session transcripts and feedback features
• Progress tracking across your training journey

This App is for enrolled participants in UST training programs only. Access is provided through invitation and program enrollment.

2. Important Disclaimer

THE APP IS NOT THERAPY, COUNSELING, OR MENTAL HEALTH TREATMENT.

• The App is for educational and personal development purposes only
• The App does not provide medical advice, diagnosis, or treatment
• The App is not a substitute for professional therapy or mental health care
• UST is a self-awareness practice, not licensed therapy
• If you are experiencing a mental health crisis, please contact a qualified healthcare provider or emergency services immediately

The AI companion is not a licensed therapist, counselor, or healthcare provider. Any guidance, exercises, or conversations are for self-reflection and personal exploration only.

3. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent that you are at least 18 years old.

4. Account Registration

To use the App, you must create an account with a valid email address as part of your program enrollment. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

5. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to harm, abuse, or harass the AI or other users
• Reverse engineer or attempt to extract the source code
• Use the App to generate harmful, abusive, or illegal content
• Share your account credentials with others
• Use automated systems to access the App
• Distribute or share app access links outside of authorized program participants

6. AI-Generated Content

The App uses artificial intelligence, including Claude models from Anthropic, Deepgram for speech-to-text, and Inworld AI for text-to-speech. You acknowledge that:

• AI responses are generated automatically and may contain errors
• AI responses should not be relied upon as professional advice
• We do not guarantee the accuracy, completeness, or appropriateness of AI responses
• You are responsible for how you interpret and act upon AI responses
• No human therapist or counselor is involved in your sessions

7. Intellectual Property

The App, including its design, features, UST methodology, and content (excluding your personal data), is owned by UNCONDITIONAL.AI PTY LTD and protected by intellectual property laws.

Your session transcripts and personal content remain yours. By using the App, you grant us a limited license to store and process this content solely to provide the service and improve our AI.

8. Privacy

Your use of the App is also governed by our Privacy Policy. Please review it carefully.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF AI RESPONSES

We do not warrant that the App will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNCONDITIONAL.AI PTY LTD SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, DATA, OR GOODWILL
• ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP
• ANY DAMAGES ARISING FROM AI-GENERATED CONTENT OR RESPONSES
• ANY CLAIMS RELATED TO EMOTIONAL, PSYCHOLOGICAL, OR MENTAL HEALTH OUTCOMES

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR AUD $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless UNCONDITIONAL.AI PTY LTD and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately.

You may delete your account at any time by contacting support@unconditional.ai.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.

15. Dispute Resolution

Arbitration Agreement

You and UNCONDITIONAL.AI PTY LTD agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be settled by binding arbitration, rather than in court.

The arbitration shall be conducted:

• In accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA)
• In Sydney, New South Wales, Australia
• In the English language

Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

You waive any right to participate in a class action lawsuit or class-wide arbitration against UNCONDITIONAL.AI PTY LTD.

Exceptions

This arbitration agreement does not apply to:

• Claims that may be brought in small claims court
• Disputes concerning intellectual property rights

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and UNCONDITIONAL.AI PTY LTD regarding the App.
